thoroughly protects property and proprietors.
Legal
persons as well as physical persons, Spanish residents as well as non-residents
can buy property in Spain. There are no
limitations as to types or number of purchasing dwellings.
Purchase
deed, signed by the Buyer and the Seller in presence of Public Notary, is sent
to territorial Register of Property, where it gets registration number (number
of record, sheet and volume). The Buyer receives a simple copy of Escritura,
which can be presented, for example, for making contracts for water, light or
gas.
If the
Buyer wishes to take mortgage, than a mortgage contract is concluded and sent for registration
together with the Escritura. The Register of
Property returns the mortgage contract and the Escritura to the bank where
the Buyer receives them. If a property
is bought by a married couple and only one of spouses is indicated in the
Escritura, than the other one becomes an owner share and share alike. But only a spouse, mentioned in the Escritura,
can obtain multivisa for 1 year.
Property
owner as well as a person, autorised by the owner and having a corresponding
power of attorney, can sell property in Spain. The Buyer can also authorise a
representative to carry on different operations, including obtaining of mortage,
payments for property and tax payments.
